Azerbaijan Permanent Residence Permit in 2026

Permanent residence is a later-stage status, not the default first permit. Current State Migration Service guidance generally allows an application after two years of continuous qualifying temporary residence on the grounds identified by the Migration Code, subject to the permanent-residence ground and documents.

Who can use this route

  • Hold qualifying temporary residence continuously for the required two-year period; current guidance treats that temporary residence as continuous when the person has not been outside Azerbaijan for more than 90 days within 180 days.
  • Continue to satisfy a permanent-residence ground under Article 52, including the applicable current asset/business threshold where relevant.
  • Pass the commission check on the official language and legal rights/obligations, unless an official exemption applies.
  • Apply to the State Migration Service at least three months before the temporary residence permit expires and provide the required accommodation/support and other documents.

Key 2026 rules and figures

The permanent residence card is issued for five years and can be extended for additional five-year periods without a stated limit on the number of extensions. The current State Migration Service FAQ ties processing to fee tiers of 35, 40, 50 or 60 days; the published adult state fees are respectively AZN 450, 400, 350 or 300. Current materials use AZN 200,000 for property, qualifying term deposits and qualifying securities; the economic-investment ground remains AZN 500,000. Business grounds use their own capital/turnover rules.

Application and renewal process

The applicant files in person or through the permitted legal-representative process and may submit the prescribed documents electronically where available. The commission checks language and legal knowledge unless an exemption applies. The State Migration Service then decides the application within the paid processing tier.

Documents and evidence

The State Migration Service requires the prescribed application, a valid passport or other border-crossing document, evidence of the specific legal ground, and the accommodation/registration evidence applicable to the case. Documents issued abroad may need the form of certification, legalization/apostille and translation required by Azerbaijani law. Applicants should use the current official checklist for the exact statutory ground rather than relying on a generic document list.

Fees and processing

Azerbaijan links several migration processing periods to the state-fee tier selected. The exact amount depends on the residence-card duration, applicant age and service speed; employment cases can also involve a separate employer-paid work-permit fee. Always confirm the current State Migration Service fee table immediately before filing.

Tax residence is a separate question

An immigration residence card does not by itself decide Azerbaijani tax residence. Article 13.2.5 of the official Tax Code treats an individual who is physically present in Azerbaijan for more than 182 days during a 12-month period ending in a calendar year as resident, with further ordered tie-break criteria when the day-count test does not decide the result. Cross-border workers should obtain tax advice for their facts.

Important limitation

Permanent residence can be cancelled in specified cases. Current guidance includes staying abroad for more than 180 days in any one year after permanent residence is issued, subject to stated statutory exceptions. Permanent residence is also separate from citizenship, whose residence calculation and other requirements are governed by separate law.
