Azerbaijan Entrepreneur and Company-Founder Residence in 2026

Azerbaijan has more than one business-based residence ground. The law distinguishes an individual entrepreneur from the head or qualifying 51% founder of an Azerbaijani legal entity with foreign investment. Simply registering a company or owning a small passive share is not the same as satisfying these residence conditions.

Who can use this route

  • An individual entrepreneur relying on Article 45.1.7 must actually operate with at least 5 full-time employees or 10 part-time employees; at least 80% must be Azerbaijani citizens or other specifically listed eligible categories.
  • After at least one year of temporary residence on the entrepreneur ground, the published renewal/continued-residence turnover requirement is AZN 50,000 for the previous year.
  • For the head or qualifying founder owning at least 51% of a foreign-invested Azerbaijani legal entity, the published temporary-residence capital requirement is AZN 50,000 paid-up charter capital; after at least one year, the legal entity must also show AZN 100,000 turnover for the previous year.
  • Statutory exemptions from some capital/staffing/turnover conditions apply to specified promoted/startup and park entities, so special cases should be checked against the current Code.

For later permanent residence on the legal-entity head/qualifying-founder ground, the official threshold table lists AZN 100,000 paid-up charter capital plus AZN 200,000 turnover in the last year. For an individual entrepreneur, it lists AZN 100,000 turnover in the last year, alongside the continuing operational staffing rule. The State Migration Service also lists entrepreneurs and qualifying company heads/founders among categories exempt from an ordinary work permit for their covered activity.

Application and renewal process

The applicant documents tax registration, the qualifying company/entrepreneur status, employment contracts where required, paid-up capital and turnover evidence from the tax authority when the relevant threshold applies. The temporary residence application is filed with the State Migration Service while lawful stay remains valid.

Documents and evidence

The State Migration Service requires the prescribed application, a valid passport or other border-crossing document, evidence of the specific legal ground, and the accommodation/registration evidence applicable to the case. Documents issued abroad may need the form of certification, legalization/apostille and translation required by Azerbaijani law. Applicants should use the current official checklist for the exact statutory ground rather than relying on a generic document list.

Fees and processing

Azerbaijan links several migration processing periods to the state-fee tier selected. The exact amount depends on the residence-card duration, applicant age and service speed; employment cases can also involve a separate employer-paid work-permit fee. Always confirm the current State Migration Service fee table immediately before filing.

Tax residence is a separate question

An immigration residence card does not by itself decide Azerbaijani tax residence. Article 13.2.5 of the official Tax Code treats an individual who is physically present in Azerbaijan for more than 182 days during a 12-month period ending in a calendar year as resident, with further ordered tie-break criteria when the day-count test does not decide the result. Cross-border workers should obtain tax advice for their facts.

Important limitation

A “Startup” certificate can affect specified statutory business requirements, but Azerbaijan does not thereby create a general startup visa that ignores the Migration Code. Do not market company formation alone as guaranteed residence.
