Azerbaijan Employment and Work Permit in 2026

For most foreign employees, paid work in Azerbaijan requires an employer to obtain a work permit from the State Migration Service. The work permit and temporary residence permit are connected but legally separate: a work permit authorizes the employment, while the residence card authorizes the person to reside in Azerbaijan.

Who can use this route

The employer must be an Azerbaijani legal person, qualifying individual entrepreneur, or branch/representative office entitled to employ the foreign worker.
The ordinary labour-migration rule looks first to whether a qualified Azerbaijani citizen is available for the vacancy and whether local labour resources can meet the need.
The employer, not the employee acting alone, applies for the ordinary work permit.
A foreign worker must also have a lawful basis for temporary residence; obtaining a work permit is itself one statutory temporary-residence ground.

Key 2026 rules and figures

The State Migration Service says ordinary work-permit applications are processed according to the fee tier in 10, 15 or 20 working days. A permit is issued for up to one year, or for the shorter employment-contract term, and each extension is normally for no more than one year. For a permit up to one year, the published employer-paid state fee is AZN 1,400 for 10 working days, AZN 1,200 for 15 working days, or AZN 1,000 for 20 working days.

Application and renewal process

The employer submits the prescribed application and employment documents to the State Migration Service. Once the employment authorization is approved, the foreign national must also hold or obtain the appropriate temporary residence permission. Applications for temporary residence are generally tied to 15- or 20-working-day fee tiers, and the applicant should file before lawful stay expires. Renewal of the work permit should be filed by the employer at least 30 days before expiry.

Documents and evidence

The State Migration Service requires the prescribed application, a valid passport or other border-crossing document, evidence of the specific legal ground, and the accommodation/registration evidence applicable to the case. Documents issued abroad may need the form of certification, legalization/apostille and translation required by Azerbaijani law. Applicants should use the current official checklist for the exact statutory ground rather than relying on a generic document list.

Fees and processing

Azerbaijan links several migration processing periods to the state-fee tier selected. The exact amount depends on the residence-card duration, applicant age and service speed; employment cases can also involve a separate employer-paid work-permit fee. Tax residence is a separate question

An immigration residence card does not by itself decide Azerbaijani tax residence. Article 13.2.5 of the official Tax Code treats an individual who is physically present in Azerbaijan for more than 182 days during a 12-month period ending in a calendar year as resident, with further ordered tie-break criteria when the day-count test does not decide the result. Cross-border workers should obtain tax advice for their facts.

Important limitation

Do not treat an entry visa, ASAN e-Visa or signed employment contract as a substitute for a work permit and residence card. The Migration Code also contains work-permit exemptions, so a person in an exempt category should verify the exemption rather than paying for an unnecessary ordinary work permit.
