Azerbaijan Family Reunification Residence in 2026

Family-based residence in Azerbaijan depends on who the sponsor is. The Migration Code includes temporary residence for a person with a close relationship to an Azerbaijani citizen and for family members of foreigners or stateless persons who already have temporary or permanent residence.

Who can use this route

  • Document the qualifying family relationship and the sponsor’s citizenship or residence status.
  • Where the statutory ground requires it, provide the notarized consent of the Azerbaijani close relative or resident family member.
  • Provide accommodation and the other general temporary-residence documents.
  • For permanent residence, the eligible citizen-relative and foreign-permanent-resident family grounds are narrower and must be checked against Article 52 rather than assumed from the temporary permit.

Key 2026 rules and figures

The work-permit rules are not identical for every family member. The State Migration Service specifically lists a foreigner married to an Azerbaijani citizen who is registered at a place of residence in Azerbaijan among people exempt from an ordinary work permit. That exemption should not be generalized to every dependent or every family-based temporary residence card.

Application and renewal process

Family applicants file the temporary-residence application with civil-status evidence, sponsor/relative consent where required, accommodation documents and other standard evidence. Permanent residence is a later stage and is not automatic merely because a temporary family permit was issued.

Documents and evidence

The State Migration Service requires the prescribed application, a valid passport or other border-crossing document, evidence of the specific legal ground, and the accommodation/registration evidence applicable to the case. Documents issued abroad may need the form of certification, legalization/apostille and translation required by Azerbaijani law. Tax residence is a separate question

An immigration residence card does not by itself decide Azerbaijani tax residence. Article 13.2.5 of the official Tax Code treats an individual who is physically present in Azerbaijan for more than 182 days during a 12-month period ending in a calendar year as resident, with further ordered tie-break criteria when the day-count test does not decide the result. Cross-border workers should obtain tax advice for their facts.

Important limitation

A legal marriage or family relationship is evidence of a statutory ground, not a waiver of the residence process. Relationship definitions, sponsor status and work rights should be verified for the specific case.
