Bahamas Family and Resident Spouse Permit in 2026

Family immigration in The Bahamas is not one undifferentiated dependant visa. A particularly important status is the resident spouse permit for a foreign national married to a Bahamian citizen. Other spouses, children and dependants may instead need ordinary residence permission linked to the family’s circumstances.

Resident spouse permit: the work-right distinction

The current Immigration (General) Regulations define a resident spouse permit as permission to remain in The Bahamas for the period stated for the purpose of residing or engaging in gainful occupation. That wording is materially different from the ordinary residence permit, which is non-work status unless a separate work visa is obtained.

So a valid resident spouse permit is not merely a visitor extension. It is a family status with an express statutory work function.

Who applies

The Department’s Resident Spouse Permit application is built around a marriage to a Bahamian citizen. The listed evidence includes:

  • covering letter to the Director of Immigration;
  • two passport photographs;
  • certified marriage certificate;
  • certified birth certificate for the applicant;
  • certified birth certificate for the Bahamian spouse;
  • documentary evidence of the spouse’s Bahamian nationality;
  • police certificate covering five years of residence; and
  • a medical certificate dated not earlier than 30 days before the application.

The Bahamian spouse also signs a declaration confirming the marriage.

Extensions and continuing relationship

The Department’s extended Resident Spouse Permit checklist asks for updated medical and police records and a valid passport, and notes that accompanying dependants must apply for a permit to reside. The underlying family relationship therefore matters both at initial application and extension.

Foreign documents require certified English translations where the Department’s checklist says so.

Fees

The 2023 Immigration Fees amendment increased the relevant resident-spouse fee schedule. Current fee treatment depends on the precise resident-spouse/family category; the amendment moved one spouse-permit category to $300 and another to $1,500, while ordinary spouse/dependant residence categories were also increased to $300.

Because the legal fee schedule distinguishes multiple spouse/family statuses, applicants should match the fee to the exact statutory category shown on the application/approval rather than assuming every spouse case costs the same amount.

Dependants

The resident-spouse extension checklist expressly says accompanying dependants must apply for a permit to reside. A child or other dependant should not assume that the resident spouse’s work right automatically transfers to them.

Ordinary dependant residence remains subject to the general rule that residence permission itself is not a blanket work visa. If a dependant later takes employment, review Bahamas work-permit rules.

Spouse residence versus permanent residence

Marriage to a Bahamian citizen can also be relevant to permanent residence, but a resident spouse permit is not itself a permanent-residence certificate. The fee regulations contain separate permanent-residence categories for spouses/surviving spouses and separate fees.

Use the permanent residence guide for that later/status-specific question and avoid assuming a resident spouse permit automatically converts on a fixed anniversary.

Practical application sequence

  1. Confirm the Bahamian citizen spouse’s documentary nationality.
  2. Obtain certified marriage and birth records.
  3. Obtain the required police certificate and current medical certificate.
  4. Prepare the covering letter, photos and passport evidence.
  5. Identify any children/dependants who need separate residence applications.
  6. Confirm the exact current fee category with the Department before payment.
  7. Keep relationship and residence evidence current for extensions.

For non-Bahamian sponsors or non-spouse relatives, the correct route may be annual residence or another category rather than the resident spouse permit.
