Argentina Work Residence in 2026

Argentina's main employee immigration route is the temporary residence for a migrant worker under Article 23(a) of Migration Law 25,871. It is intended for a foreign national who is hired to perform lawful, paid work in Argentina under a relationship of dependency.

This is more precise than the generic phrase “Argentina work visa.” The residence basis depends on a real Argentine employment relationship and employer documentation, not simply on having professional skills or foreign freelance income.

Who qualifies?

The current DNM migrant-worker procedure is aimed at foreigners contracted as employees. The applicant needs an employment pre-contract that identifies the proposed work and employment conditions.

DNM says the pre-contract should state elements including:

  • the tasks to be performed;
  • working hours;
  • duration of the relationship;
  • workplace; and
  • remuneration consistent with the applicable collective-bargaining framework.

The signatures must satisfy DNM's certification rules.

Employer requirements

The employer is not just a name on a letter. DNM's current procedure calls for employer tax-registration evidence and registration in RENURE, the National Single Registry of Foreign Applicants/Requesters used by Migraciones.

The current page also requires the employer to complete the relevant tax/labor registration step (“alta temprana”) within 30 calendar days from the start of the residence request, under the published procedure.

A job offer from an employer that cannot or will not complete the migration and labor-registration requirements is therefore not equivalent to an approvable work-residence case.

Personal documents

The DNM checklist includes route-appropriate versions of:

  • valid passport or accepted MERCOSUR identity document;
  • Argentine criminal-record certificate for applicants above the stated age;
  • foreign criminal-record certificates covering relevant prior residence;
  • proof of domicile in Argentina;
  • proof of regular entry; and
  • the employment and employer documents described above.

Foreign documents can require apostille/legalization and Spanish translation.

How long is Argentina work residence valid?

The consolidated Migration Law allows an Article 23(a) worker residence for up to three years, renewable, with multiple entry and exit and permission to work under relationship of dependency.

However, DNM's current operational worker-residence service describes a one-year residence, renewable. That discrepancy is important. The law sets a ceiling; it does not guarantee that an initial applicant receives the maximum statutory term.

For practical planning, use the validity period stated on the residence DNM actually grants and follow the live renewal procedure.

Renewal

DNM's worker-renewal guidance requires evidence that the employment basis continues or that a qualifying new employment relationship exists. Published requirements include employer tax details, CUIL and, where applicable, a new employer's RENURE registration.

A worker changing employers should not assume the old employer's documents automatically satisfy the new residence evidence. Review the renewal/change procedure before the existing residence nears expiry.

Can the holder work legally?

Yes. This is a temporary-resident employment category, and Article 51 of the current Migration Law permits temporary residents to perform remunerated or lucrative activity during the authorized residence period. Article 23(a) specifically contemplates work under relationship of dependency.

Immigration permission does not replace labor registration, tax, social-security or professional-licensing rules. Regulated professions can have separate recognition or licensing requirements.

Fees

DNM's current fee table lists temporary residence at:

  • 50 UMSM for MERCOSUR/associated-state applicants; and
  • 100 UMSM for extra-MERCOSUR applicants.

The same official table currently states 1 UMSM = ARS 1,000, corresponding to ARS 50,000 and ARS 100,000 respectively at the verified date. Additional costs can arise for records, apostilles, translations, urgent services or consular procedures.

A MERCOSUR national should also compare the MERCOSUR nationality residence, because nationality residence may avoid making one employer the immigration criterion.

Processing time

The current DNM worker page does not promise one universal end-to-end processing SLA. Timing depends on document completeness, employer compliance and DNM processing. ReloTide therefore does not state a guaranteed “30-day Argentina work visa” or similar unsupported number.

The published 30-day rule mentioned above concerns the employer's early labor-registration step; it should not be misrepresented as DNM's decision deadline.

Family members

Defined family members may have a separate family reunification residence linked to a temporary resident. The family member's status should be documented separately; a principal worker's approved residence does not mean a spouse or child should simply remain as a tourist indefinitely.

Permanent residence pathway

DNM's current permanent-residence guidance publishes time-based transition criteria of three years of temporary residence for non-MERCOSUR nationals and two years for MERCOSUR nationals, subject to the current legal requirements and the qualifying residence history.

For the time-based path, DNM says the applicant must show presence in Argentina for more than 50% of the temporary-residence period granted. The 2025 reform also changed the current Article 22 framework and excludes residencia precaria from the arraigo calculation.

Work residence vs digital nomad residence

These routes solve different problems:

  • Digital Nomad: transitory stay, remote services for persons/entities abroad, not ordinary local employment.
  • Migrant worker: temporary residence based on Argentine employment under relationship of dependency.

A remote employee of a foreign company should not use an Argentine employment pre-contract that does not reflect the real relationship. Likewise, someone actually hired by an Argentine company should not describe local employment as foreign digital-nomad activity.

Tax and social-security planning

An Argentine employment relationship normally creates local payroll, tax and social-security obligations. Separately, ARCA applies tax-residence rules that are not identical to immigration status. Applicants relocating for employment should coordinate immigration onboarding with employer payroll and tax compliance.

Application checklist

Before filing:

  1. confirm the role is genuine Argentine employment under relationship of dependency;
  2. verify the employer's tax and RENURE readiness;
  3. prepare a compliant pre-contract with duties, term, workplace, hours and remuneration;
  4. collect identity, criminal-record, domicile and regular-entry documents;
  5. check translations/apostilles; and
  6. use the live DNM fee and RadEx instructions on the filing date.
