Germany's so-called Freelance Visa is the residence route for a person intending to carry on a qualifying liberal profession (freiberufliche Tätigkeit). The legal basis is §21(5) of the Residence Act, not a generic digital-nomad permission.
It can suit independent professionals such as consultants, artists, writers and members of recognised liberal professions where the actual activity fits German law. It is different from §21(1), which covers a commercial self-employed business such as a conventional company or startup founder.
Legal basis and eligibility
Section 21(5) allows a residence permit for the pursuit of a freelance activity. Current federal guidance requires the applicant to show that:
- the proposed freelance activity is genuinely viable;
- financing of the project is secured;
- the applicant can support themselves in Germany;
- any professional practice permission required for the occupation is available; and
- applicants older than 45 can demonstrate adequate retirement provision where the statutory rule applies.
There is no rule that every person with foreign clients automatically qualifies as a Freiberufler. German authorities look at the nature of the profession and how it is legally classified.
Freelancer versus commercial entrepreneur
This distinction affects immigration, registration and taxation.
A freelancer under §21(5) carries on a qualifying liberal profession. A commercial entrepreneur normally applies under §21(1), which asks whether the business serves an economic interest or regional need, has a positive economic effect and is financed.

Permit validity and renewal
Current federal guidance states that the residence permit for self-employment/freelance activity can initially be issued for up to three years. Renewal depends on whether the freelance activity remains genuine, viable and compatible with the issued residence conditions and whether the applicant continues to meet livelihood and insurance requirements.
Family
Family reunification is governed by the Residence Act, not by a separate “freelance family visa.” A spouse/partner and qualifying children can have family routes subject to the applicable statutory conditions. The exact livelihood, housing, language and work-right rules depend on the sponsor's title and family member.
Applicants should not assume every skilled-worker family exemption automatically applies to every freelance scenario; verify the applicable provision and the wording of the issued title.
Can a freelancer employ people or run a company?
A §21(5) permit is tied to freelance activity. Material changes toward a commercial business model can require reassessment or a change of residence conditions/title. Registering a company does not automatically convert a freelancer into a lawful commercial entrepreneur for immigration purposes.

That is an important distinction from the special three-year settlement rule for a successful commercial entrepreneur under §21(4). Do not automatically apply the entrepreneur's three-year timeline to a §21(5) freelancer.
Citizenship
German citizenship is separate from settlement. Current §10 of the Citizenship Act generally uses five years of lawful habitual residence for the ordinary entitlement route, together with the other statutory identity, constitutional commitment, livelihood, language, legal-order and naturalisation-test conditions.
The former three-year accelerated naturalisation option has been removed and should not be advertised as a current 2026 pathway.
