American Samoa Foreign Investor Permit in 2026

American Samoa has a real statutory foreign-investor entry permit, but it is not a broad startup visa or small-business entrepreneur program. It is tied to a qualifying foreign investment under the Territory's investment law, followed by a separate immigration entry-permit application.

The capital thresholds are substantial. A qualifying foreign investment is generally at least $1,000,000 per investor for an individual enterprise, or at least $250,000 per investor in a group enterprise capitalized at no less than $5,000,000.

This is not a generic startup visa

Searches for an “American Samoa startup visa” or “American Samoa entrepreneur visa” can be misleading. The current public immigration portal does not publish a general founder visa, freelancer visa or low-capital entrepreneur residence category.

The foreign-investor permit is a narrow statutory route for approved qualifying foreign investment. A small founder, sole proprietor or remote freelancer should not assume this route applies simply because the person starts a local company.

For general business founders, immigration permission, business registration, licensing and any work authorization remain separate questions. The Department of Commerce says businesses operating in the Territory need the applicable business license, while immigration regulations separately give the Immigration Board a role in alien business-license cases.

Qualifying investment thresholds

Under A.S.C.A. § 27.2602, a qualifying foreign investment generally means:

  • individual enterprise: at least $1,000,000 invested by each investor; or
  • group enterprise: at least $250,000 per investor, with the group enterprise capitalized at not less than $5,000,000.

The statutory definition also includes an export-oriented condition: the enterprise generally must derive at least 60% of its gross receipts from sources outside American Samoa.

These are statutory investment thresholds, not an immigration income test for ordinary employment or family residence.

Step 1: foreign-investment certificate

The investment framework requires an application for a certificate of foreign investment. A.S.C.A. § 27.2611 sets the non-refundable certificate application fee at $2,500.

The application process requires substantial information about the proposed enterprise, investors, financing, projected operations and compliance. The Director reviews the proposed investment under the statutory criteria.

Investment approval timing

The foreign-investment statute contains its own decision periods. A.S.C.A. § 27.2607 provides that the Director issues an approval or denial letter within 120 days of receiving the qualifying application materials. If approved, the investor generally has 180 days to obtain the necessary financing and submit the required evidence.

After required financing documents are submitted, A.S.C.A. § 27.2608 provides a further certificate-issuance process: the Director has 30 days to issue or deny the certificate, followed by gubernatorial review under the statute.

These time limits apply to the foreign-investment certificate process. They should not be confused with ordinary P-45 employment residency, P-12 family residence or visitor permits.

Step 2: foreign-investor entry permit

After the investment approval/certificate requirements are satisfied, the investor can use the separate immigration route in Title 41.

A.S.C.A. § 41.0802 sets the foreign-investor entry-permit application fee at $500. The statutory definition allows the permit to include the qualifying investor's spouse and up to two dependent children.

The application must establish the qualifying approved investment and the applicant's eligibility under the investor-permit chapter.

Investor permit processing time

For a complete investor entry-permit application, A.S.C.A. § 41.0803 provides a specific decision rule: the Attorney General must issue or deny the permit within 15 days.

That 15-day period is for the immigration permit stage, not the earlier foreign-investment certificate review. The full project timeline can therefore be much longer than 15 days.

Validity and renewal

The statutory foreign-investor entry permit is valid for one year. It may be renewed annually as long as the approved enterprise continues in operation and the investor remains qualified under the statute.

Renewal is not a promise of permanent residence. The investor must continue satisfying the investment and enterprise requirements.

What rights does the permit give?

The investor permit authorizes entry and stay connected with the approved investment, but the statute expressly limits what it creates.

A.S.C.A. § 41.0803 states that the permit does not confer:

  • permanent-resident status;
  • U.S. nationality or citizenship;
  • voting rights;
  • the right to hold elective office; or
  • land-ownership rights beyond what territorial law otherwise permits.

This is why the route should not be described as a “golden visa” leading automatically to permanent residence.

Investor permit blocks permanent-residence application while held

A.S.C.A. § 41.0805 adds an important restriction: a person holding the foreign-investor entry permit is excluded from applying for another preference or permanent residence while the investor permit remains in force. The investor must leave the Territory before applying under another provision as required by that statute.

This makes the route materially different from investor programs in jurisdictions where investment residence directly accumulates toward permanent residence.

Family members

The investor-permit definition can include the investor's spouse and up to two dependent children. That inclusion is specific to the investor chapter and should not be generalized to every relative.

Other relatives generally need their own qualifying status, such as the ordinary family residence route if eligible.

Business licensing is separate

The Department of Commerce says businesses operating in American Samoa are subject to licensing requirements and that business licenses generally expire at the end of each calendar year and require renewal.

The immigration permit, foreign-investment certificate, corporate registration and business license are distinct legal steps. Approval in one system does not eliminate the requirements of the others.

Alien business ownership rules

American Samoa immigration regulations give the Immigration Board a role in alien business-license applications. The published rule states that alien applicants are not approved as sole proprietors under that policy, though aliens may participate as partners, founders or stockholders in partnerships or corporations.

That rule reinforces why the investor permit is not a generic self-employment visa.

No separate freelancer or digital-nomad route

The current immigration framework does not publish a dedicated freelancer visa, self-employment visa, remote-worker visa or digital nomad visa.

A person serving foreign clients online or running a small remote business should not treat visitor permission as business/work authorization or assume the million-dollar investor regime is the only possible answer.
